Terms of Use
1. Acceptance of these Terms
These Terms of Use ("Terms") are an agreement between you and Tristan David ("we", "us") governing your use of the Transly Pocket mobile application ("Transly Pocket", the "app"). By downloading or using the app, you agree to these Terms. If you do not agree, do not use the app.
2. What Transly Pocket is
Transly Pocket records and imports audio, turns speech into text, labels speakers, and translates and summarizes text, using AI models that run on your phone.
AI output can be wrong. Transcripts, translations, speaker labels and summaries are produced automatically and may contain mistakes, omissions or misattributions. Check anything important against the original audio. Don't rely on the app where a mistake could cause harm, for example for medical, legal, safety or emergency purposes.
3. Recording other people
You are responsible for how you use the app. Many places require the consent of everyone being recorded. Obtain any consent the law requires before recording, and respect the rights of the people and organizations you record, such as the rules of a school or workplace.
4. Free plan and Transly Pro
Transly Pocket is free to download and includes a monthly amount of transcription and a daily amount of live translation. Transly Pro is an optional purchase that removes these limits and unlocks additional features. It is offered as:
- a monthly subscription, renewing every month;
- a yearly subscription, renewing every year, which may include a 7-day free trial for new subscribers;
- a lifetime one-time purchase, which doesn't renew.
The price for your region is shown on the purchase screen before you confirm.
Billing. Payment is charged to your Apple App Store or Google Play account when you confirm the purchase. Subscriptions renew automatically at the same price unless auto-renew is turned off at least 24 hours before the end of the current period. Your account is charged for renewal within 24 hours before the period ends.
Free trial. If you start a free trial and don't cancel at least 24 hours before it ends, it converts automatically into a paid subscription. Any unused portion of a free trial is forfeited when you buy a subscription.
Managing and cancelling. Manage or cancel a subscription in your store account: on iPhone, Settings › your name › Subscriptions; on Android, the Play Store › Payments & subscriptions. Deleting the app does not cancel a subscription.
Refunds. Purchases are handled by Apple and Google, and refunds are subject to their policies. Contact Apple Support or Google Play Support for refund requests.
Changes. We may change prices or what Transly Pro includes. A price change takes effect only at your next renewal, and you'll be told in advance and given the chance to cancel, as your store requires.
5. Your content
Your recordings, transcripts and translations belong to you. They are stored on your device, not by us, so keep your own copies (for example by exporting) of anything you can't afford to lose. Deleting the app or a recording removes it permanently.
6. AI models and third-party software
The app downloads and uses AI models and software made by others, including OpenAI's Whisper, Useful Sensors' Moonshine, speaker models from pyannote and 3D-Speaker, Argmax's WhisperKit and SpeakerKit, sherpa-onnx, and Google ML Kit. They are provided under their own licenses, and Google ML Kit is also subject to Google's ML Kit terms.
7. Acceptable use
You agree not to use the app to break any law or to violate anyone's privacy or other rights, and not to reverse engineer, decompile or tamper with the app except where that right can't lawfully be restricted.
8. Termination
You may stop using Transly Pocket at any time by deleting it. We may suspend or end access if you materially breach these Terms, or if we discontinue the app.
9. Disclaimer of warranties
The app is provided "as is" and "as available", without warranties of any kind, express or implied, including any implied warranties of merchantability, fitness for a particular purpose, accuracy or non-infringement. We don't warrant that the app will be uninterrupted or error-free, or that any transcript, translation or summary is accurate.
10. Limitation of liability
To the fullest extent permitted by law, we are not liable for any indirect, incidental, special, consequential or punitive damages, or for lost profits or lost data, arising out of or relating to your use of the app. Our total liability for any claim relating to the app is limited to the amount you paid for it in the twelve months before the claim arose. Some jurisdictions don't allow certain exclusions or limitations, so parts of this section may not apply to you. Nothing here limits liability that can't lawfully be limited.
11. Apple and Google
These Terms are between you and us, not with Apple or Google. Apple and Google are not responsible for the app or its content and have no obligation to provide support for it. Apple and its subsidiaries are third-party beneficiaries of these Terms and may enforce them against you. If you downloaded the app from the App Store, Apple's Standard End User License Agreement also applies.
12. Changes to these Terms
We may update these Terms from time to time. When we do, we'll update the date above and, for material changes, note them in the app's update notes. Continuing to use the app after an update means you accept the revised Terms.
13. Governing law
These Terms are governed by the laws of the Province of Ontario and the federal laws of Canada applicable there, without regard to conflict-of-laws rules. This doesn't deprive you of the protection of mandatory consumer-protection laws where you live.
